Johanne Marcoux is a certified public accountant practicing in public accounting since 1993. She obtained her accounting degree from Laval University in Quebec City, Canada. She is a certified public accountant licensed in the states of Florida and Michigan, and also maintains her Canadian CPA-CA license in the province of Ontario.

Prior to managing her own CPA practice, she started her career in the audit department of Deloitte & Touche in Quebec City, Canada. When she relocated to South Florida, she joined a local South Florida CPA firm where she became a shareholder.

Her areas of expertise are in the taxation of both individual and corporate clients as well as tax planning for US residents and nonresident aliens. Additionally, she specializes in FIRPTA and international cross border tax issues.

Angela Grealy - EA, Tax Accountant

Originally from the United Kingdom, Angela Grealy joined Marcoux CPA in 2017. She graduated from Florida Atlantic University with a Bachelor of Science degree in Business Administration with a concentration in Accounting. She obtained the Enrolled Agent status issued by the IRS which allows her to represent taxpayers before the IRS. She specializes in FIRPTA, preparation of non-US residents tax returns and preparation of payroll tax returns.

Jacqueline Gagnon - Administration, FIRPTA support and Customer Service

Jacqueline Gagnon joined the firm in 2014. Growing up both in the US and Canada, she can serve our clients in either languages. Her responsibilities are to assist our clients with their FIRPTA real estate closings. She also performs QuickBooks bookkeeping services for our clients and support the overall firm’s operation with her administrative skills and experience in the industry.

Jocelyne Mathieu is originally from Quebec, Canada and moved to the United States in 1998. She joined the firm in 2016. With her past employment experiences working directly with French Canadians in Florida, she brings to the firm a strong understanding of our clientele’s needs. Jocelyne Mathieu is the first person that our clients encounter when first contacting the firm. She also provides support for the overall internal operations of the firm.

FAQ

What is “FIRPTA” withholding?

Answer

FIRPTA stands for Foreign Investor Real Property Tax Act. When a nonresident alien sells a U.S. real property interest, the seller is subjected to a 15% withholding tax on the gross proceed from the sale. Exceptions exist where the 15% withholding tax is decreased to 0% or 10% depending on the sale price and the type of buyer and their intended use of the property. If a withholding tax applies at the time of the sale, this withholding tax can be refunded partially or in its entirety depending on the amount of capital gain.

Do I need an “ITIN” number?

Answer

An individual taxpayer identification number is a tax identification number issued by the Internal Revenue Service (“IRS”). This number is required in order to file a tax return with the IRS and to receive a tax refund from the IRS.

Can I obtain a U.S social security number?

Answer

U.S. social security numbers are issued by the Social Security Administration with the proper immigration status or proof of U.S. citizenship. Individual taxpayer identification numbers (“ITIN”) are issued by the Internal Revenue Service (“IRS”) strictly for tax purposes. An ITIN does not provide social security benefits and does not give the right to work in the United States.

I received a phone call from the IRS pertaining to tax due and requesting payment?

Answer

There are very special and limited circumstances in which the Internal Revenue Service (“IRS”) will call a taxpayer. Even then, the taxpayers will generally receive several letters (called “notices”) from the IRS. The IRS would never demand that you use a specific payment method such as a wire transfer, prepaid debit card or gift card. They also would not ask you for a debit card number or a credit card number over the phone. The IRS would not threaten to bring in law enforcements to arrest you for not paying.

If you receive such phone calls, do not volunteer any payment information. If you suspect a phone scam, you should hang up. If you are still uncertain or worried you might owe taxes, you should call the IRS and inquire about the status of your account.

I am a nonresident alien and I sold my U.S real estate property. Do I need to do a U.S tax return?

Answer

Yes. Sale of U.S. real estate needs to be declared in a U.S. tax return.

I am a nonresident alien and I earn rental income in the U.S. Do I need to do a U.S tax return?

Answer

You have a choice.
1 - Remit to the Internal Revenue Service (“IRS”) 30% of the gross rental income received
or
2 - Elect to declare the rental income in a U.S. tax return and deduct against it the rental expenses.
Method #2 is usually the most tax effective solution

I am a nonresident alien and will have to pay U.S income tax on the sale of my U.S property or on U.S rental income. Will I be double taxes in my country of residence?

Answer

Many countries tax their residents on their worldwide income. To alleviate the problem of double taxation, many of these countries also allow the deduction of the US taxes paid against the tax you will owe them on the foreign income you earned. Please check with your home country tax experts if you will be allowed to claim a foreign tax credit to avoid double taxation.

I sold my real estate property and I have a taxable capital gain. Can I defer the taxation of the capital gain by buying another property?

Answer

It is possible to “defer” the taxation of a capital gain by buying another property. This process is referred to as a Section 1031 exchange. Many rules and restrictions need to be followed in order to benefit of this tax advantage. Additionally, if you are a nonresident alien and you are considering a section 1031 exchange transaction and you are taxed on your worldwide income in your country of residence, you need to consult with your tax professional in your country of residence to find out the tax impact of the sale of the property.

I filed my U.S tax return and I never received any written ackowledgment or letter or statement of account from the IRS. Is this normal?

Answer

If the Internal Revenue Service (“IRS”) made no change to the tax return filed, you will not receive written correspondences from the IRS. The IRS will mail you a notice if among other things, they made a correction to the tax return you filed, if you owe money, if they request additional information to process the tax return, if you are subjected to an IRS audit.

Can I obtain a written confirmation from the IRS that they received my tax returns and if any corrections were made to my tax return?

Answer

Yes. You can request a tax transcript from the Internal Revenue Service (“IRS”). The IRS can provide you with different type of tax transcripts depending on your need. Examples: tax return transcript, tax account transcript, record of account transcript, wage and income transcript and verification of non-filing letter. If the IRS changes something to the tax return that was filed, they will mail you a notice explaining the changes.
